
MIAMI BEACH, FLORIDA — Jack Daniel Gutierrez, 24, has been charged with aggravated battery after allegedly slashing a man's throat during a violent confrontation on the beach. The attack reportedly occurred after the victim refused to give Gutierrez a cigarette or lend him a cellphone.
Violent Rejection on the Beach
The incident took place on October 23, 2025, near the 1700 block of Collins Avenue. According to the arrest report, the victim was sitting near a lifeguard tower when he was approached by Gutierrez.

Authorities state Gutierrez asked the man for a cigarette, to which the victim replied he did not smoke. When Gutierrez subsequently asked to borrow the man's phone and was rejected again, the victim believed the interaction was over.
"Ear to Ear" Laceration
As the victim looked away, Gutierrez allegedly attacked him from behind with a knife or bladed weapon. Police describe the resulting injury as a large laceration stretching "from ear to ear."

Despite the heavy loss of blood, the victim managed to use his phone's voice-activated Siri function to call 911. He was transported to a nearby hospital for treatment and later identified Gutierrez in a photo lineup.
Suspect Held Without Bond
Police arrested Gutierrez on Thursday following a months-long search. Jail records indicate he was already on probation for a weapons charge at the time of the attack.

He is currently being held at the Turner Guilford Knight Correctional Center without bond and is expected to appear in court today.
