Percy Levar Walton was convicted for the murders of three people in November 1996 in Danville, Virginia. The victims were Elizabeth Kendrick, who was 81 years old, her husband Jessee Kendrick, who was 80, and Archie Moore, who was 33. Walton was arrested and charged with these crimes.

In 1997, Walton was found guilty and sentenced to death. His execution was initially scheduled for June 8, 2006. However, just one hour before it was set to occur, Virginia's governor, Tim Kaine, stayed the execution. He ordered a mental evaluation to determine if Walton was fit for execution. During this time, it was reported that Walton had an IQ of 66, though some tests indicated it could be as high as 90.

Governor Kaine expressed concerns about executing or pardoning Walton without further investigation into his mental state. He decided to have the court review the evaluation results and scheduled a new execution date for December 9, 2006. This decision was met with criticism from political opponents who felt he was lenient on crime.

Eventually, the state set another execution date for June 10, 2008. However, on June 9, 2008, Governor Kaine commuted Walton's sentence to life in prison without parole. The governor stated that Walton might not fully understand the punishment he was facing.

After his sentence was commuted, Walton was moved to the Marion Treatment Center, a facility designed for mentally ill inmates. His attorney described him as extremely mentally ill and profoundly impaired. As of 2023, Percy Levar Walton is housed at the Greensville Correctional Center.
