Sheppard was 22 years old at the time of the murders. He admitted being at the crime scene, as his fingerprints were found in numerous locations. However, he claimed that Graham was the one who killed the couple. Leading up to the murders, Sheppard had an established relationship with the Rosenbluths. He had previously sold cocaine to Richard, who owed him money. Sheppard testified that he and Graham, along with a third individual named Benji Vaughan, went to the Rosenbluth home early that morning.
The prosecution provided circumstantial evidence that pointed to Sheppard's ownership of the firearm used in the murders. A few weeks before the incident, he had accidentally shot Vaughan with the same gun, and his father had seen it in his room just days before the crime. The jury found Sheppard guilty, and he was sentenced to death in December 1994.
Graham, who was involved in the murders, received a life sentence. He was also on death row for another murder. The investigation revealed that the couple had a history of drug use. Autopsies confirmed the presence of cocaine in their systems, and drug paraphernalia was found in their home.
Mark Arlo Sheppard was executed by lethal injection in Virginia on January 20, 1999. At 27 years old, he became the first inmate to be executed in Virginia that year. While he stood before the warden for his final statement, he mumbled a few dates, each followed by "I love you," which his attorney suggested might have been the birthdays of close friends or family members.
