On August 15, 1996, Kenneth Eugene Foster Jr. was involved in a series of armed robberies in San Antonio, Texas, with three friends: Julius Steen, Mauriceo Brown, and Dwayne Dillard. During their night out, they came across Michael LaHood Jr. outside his parents' house. Mauriceo Brown left the car they were in and shot LaHood in the head, resulting in LaHood's death.

Foster was later arrested and convicted of capital murder under Texas's law of parties. This law holds individuals responsible for the actions of others if those actions occur during the commission of a felony. Foster did not pull the trigger but was still given a death sentence for his involvement in the robbery that led to LaHood's death. His conviction raised questions about the fairness of holding someone accountable for a crime they did not physically commit.

Foster was placed on death row on July 1, 1997, and initially housed in the Ellis Unit before being moved to the Allan B. Polunsky Unit in 1999. His death sentence was commuted to life imprisonment shortly before his scheduled execution on August 30, 2007, by Texas Governor Rick Perry. Foster became eligible for parole in 2036.

In 2021, while serving his life sentence at the Telford Unit, an altercation occurred, resulting in the death of his cellmate, Anthony Dominguez. Video evidence suggested Foster's involvement in this incident, which could lead to new murder charges against him. If convicted, he could potentially face death row again.
