At that time, Juan was under home confinement while being monitored by the Delaware Department of Corrections. His monitoring device was placed in the back bedroom of Deborah's house.

Earlier that day, he had told Deborah's daughter, Ashley, that trouble was brewing when Deborah returned home. Deborah was at a friend's house, preparing to come home later. During this time, Ortiz left the house, then quickly returned after about three minutes.
After Ortiz left, smoke began to rise from the house. A neighbor noticed the smoke and called for help. When firefighters arrived, they found the home ablaze. Inside, they discovered Deborah's body in the bathroom. It had been decapitated, and she also had gunshot wounds to her abdomen and head.
The police found evidence indicating that the fire had been intentionally set. They discovered a burned shotgun inside the house, which was linked to the murder. Police later arrested Ortiz nearby. He admitted to shooting Deborah while she was in the shower. He claimed he did not mean to harm her, stating that he thought the gun was on safety when he fired.
