Georgia Caruso was selling diamonds and had been in contact with Vining, who used the name "George Williams." Caruso and Vining went to a gem lab for an appraisal of the jewelry. After this meeting, Caruso told her employee that she was going to the bank with Vining to finalize the purchase of the diamonds.
Caruso's body was discovered on December 8, 1987, in Apopka, Florida. It was identified through dental records. She had died from two gunshot wounds. A black Cadillac, which belonged to Vining's mother, was found burning shortly after Caruso's body was found.
On May 5, 1989, the Orange County Sheriff’s Department issued a detainer against John Vining, who was already in prison in Georgia for kidnapping and aggravated assault. He was indicted for first-degree murder and armed robbery on June 5, 1989. Vining was arrested on September 1, 1989.
During the trial, Vining was found guilty of both charges on February 1, 1990. The jury recommended the death penalty by an 11 to 1 majority. On April 9, 1990, he was sentenced to death for the murder and received a life sentence for armed robbery.
Vining filed several appeals, including a direct appeal to the Florida Supreme Court and a Petition for Writ of Certiorari to the United States Supreme Court. His appeals were largely denied.
