Murder Story

In October 2000, Homer Roseberry, along with Diane Roseberry and Charles Dvoracek, was involved in a plan to steal drugs and money. They intended to re-sell the drugs. Roseberry was trafficking about thirteen hundred pounds of marijuana with the victim, Fred Fottler. The two met in Phoenix and then drove to Las Vegas with the marijuana.

While traveling along Highway 93, they stopped at a pull-off area. There, Roseberry shot Fottler three times in the back of the head. After the shooting, Roseberry disposed of Fottler's body in the weeds by the highway. He then continued his journey to Las Vegas with the drugs. To hide evidence, he threw the gun out several miles away from where Fottler's body was left.

Diane Roseberry was sentenced to seven years in prison, and Charles Dvoracek was given a ten-year prison sentence for their roles in the crime. Roseberry faced trial that started on December 4, 2002. The jury reached a verdict on December 19, 2002. On July 14, 2003, he was sentenced to death.
