2003Gerald Edward Marshall was born on July 11, 1982, in Bell County, Texas.
On May 11, 2003, Gerald Edward Marshall, along with three co-defendants, entered a Whataburger restaurant in Harris County, Texas, to commit a robbery. During this incident, Marshall shot a male employee, who had a mental disability, in the head. The shooting resulted in the employee's death.
The robbery took place early in the morning, around 4:00 a.m. The assailants approached the Whataburger drive-through window in a car. One of them entered the restaurant armed with a pistol. Witnesses reported hearing the victim being threatened for the keys to the safe before he was shot.
After the shooting, the group fled the scene. Law enforcement later found the car used in the robbery at the home of Marshall’s aunt. Evidence presented during the investigation indicated that the robbery may have involved the night-manager of the Whataburger, who was supposed to assist with the robbery but left before it occurred.
Marshall was arrested and charged with capital murder. At trial, evidence from witnesses, including employees who were in the restaurant during the robbery, helped establish Marshall's role in the crime. A jury convicted him, and on December 8, 2004, he was sentenced to death for his actions during the robbery and murder.
