David Miller Jr. was born on September 6, 1959, in the United States. Before the murder of Albert Floyd, Miller already had a criminal record. One of his earlier violent crimes later became important during sentencing. Court records also mentioned his alcohol use, drug use, early life, and mental health.

By March 1997, Miller was in Jacksonville, Florida. On the day of the crime, he said he had been drinking beer and using crack cocaine. He later told police he was looking for money and more beer when he found a long, dented pipe in a park.

Miller then walked behind a building and saw Albert Floyd sleeping under a blanket. He later said he did not decide to rob Floyd until he was standing over him with the pipe. Miller claimed he hit Floyd to stop him from fighting back, but the injuries showed that Floyd had been struck several times in the head.

Linda Fullwood was sleeping near Floyd. When she woke up and screamed, Miller struck her with the pipe too. A witness named Jimmie Hall heard her screams and ran to the scene. Hall saw the attack and yelled for Miller to stop. Miller then ran away.

Miller later surrendered in Louisiana and told police he had killed someone in Jacksonville. After being read his rights, he described the attack and later showed detectives where it happened. His confession, the witness account, and the medical evidence became key parts of the case against him.

Murder Story

On March 6, 1997, David Miller Jr. attacked Albert Floyd in Jacksonville, Florida. Floyd was a homeless man who was sleeping behind a building. Linda Fullwood was sleeping nearby. Before the attack, Miller later said he had been drinking beer and using crack cocaine. He said he was looking for money and more beer when he found a dented six-foot pipe in a park. He then walked behind a building and saw Floyd asleep under a blanket.

Miller told police that he did not decide to rob Floyd until he was already standing over him with the pipe. He claimed he hit Floyd to stop him from fighting back. However, the attack was very severe. Miller struck Floyd in the head several times with the pipe. The blows fractured Floyd’s skull and injured his brain. Floyd died from the head injuries.

Linda Fullwood woke up during the attack and screamed. Miller then struck her with the pipe. She survived, but she was injured. A witness named Jimmie Hall heard her screams and ran toward the scene. He saw a man beating two people with a pipe and yelled for him to stop. Miller then ran away.

The case remained unsolved until June 1997. At that time, Miller spoke to a police officer in Louisiana and said he had killed someone in Jacksonville. He told investigators that his conscience was bothering him and that he wanted to apologize to the victim’s family.

After Miller was returned to Jacksonville, he showed a detective where the attack happened and explained what he had done. His confession matched the witness account and the medical evidence. Prosecutors charged him with first-degree murder for Floyd’s death and aggravated battery for attacking Linda Fullwood.

A Duval County grand jury indicted Miller on June 26, 1997. His trial took place in 1998. On June 25, 1998, the jury found him guilty of first-degree murder and aggravated battery with a deadly weapon. During sentencing, the jury recommended the death penalty by a 7–5 vote. On July 24, 1998, the judge sentenced Miller to death for the murder of Albert Floyd. He also received 25 years in prison for the aggravated battery of Linda Fullwood.

Miller appealed his conviction and sentence. On August 31, 2000, the Florida Supreme Court upheld both his conviction and death sentence. Miller later filed more appeals and post-conviction challenges. In 2006, the Florida Supreme Court denied relief. In 2018, the court also rejected another claim related to Florida death penalty law.

Miller continued fighting his case in federal court. In 2021, a federal court still described him as a Florida prisoner under a death sentence. His U.S. Supreme Court petition was denied on April 17, 2023. Based on available records, David Miller Jr. remains under a death sentence and should be listed as Awaiting Execution unless a newer official record shows a change.
