On June 26, 2006, Sofia Rodriguez-Urrutia Shu, an eight-year-old girl, was at the Livingston Shopping Centre in Canning Vale with her family. While they were waiting, she went to the toilet. Dante Wyndham Arthurs, who worked at the shopping centre, followed her. After she left the female toilets, Arthurs grabbed her from behind and took her into a nearby disabled toilet cubicle. He locked the door behind him.
Sofia's family began to worry when she did not return. Her 14-year-old brother looked for her. He called her name at the female toilet door, but there was no answer. He went back to the main area, and then he returned to the disabled cubicle after hearing noises inside. He knocked on the door and called for Sofia again. After a few moments, he opened the now-unlocked door and found her lifeless body on the floor.
A search of the shopping centre did not find Arthurs, and the police closed the entire area as a crime scene. The investigation began quickly, and detectives looked into a few potential suspects. They soon focused on Arthurs, as he was already known to the police due to a prior sexual assault on another young girl in the area three years earlier. The day after Sofia's body was discovered, police visited Arthurs' home and arrested him.
During interrogations, Arthurs admitted to digitally penetrating Sofia. However, it was not clear if this occurred before or after her death. The attack lasted only a few minutes, and during that time, Sofia's brother had knocked on the toilet door, but it was uncertain if Sofia was still alive at that moment.
Arthurs was charged with wilful murder, sexual penetration of a child, and deprivation of liberty. He pleaded not guilty to all charges. His case went to trial, where Justice Peter Blaxell ruled that some of Arthurs' admissions to police could not be used as evidence against him. He later pleaded guilty to the lesser charge of murder and unlawful detention, while the sexual penetration charges were withdrawn.
On November 7, 2007, Arthurs was sentenced to life in prison with a minimum term of 13 years. The court noted the severity of his actions, stating they were "so evil they shock the public conscience." After his conviction, it was revealed that he had previously been under investigation for another sexual assault in 2001, but had never been charged due to leaving Britain before legal proceedings commenced.
Following this case, the Western Australian government made changes to the laws concerning murder and introduced a public sex offender register. Over the years, Arthurs has applied for parole but has been denied multiple times. As of now, he remains in prison and is next due to be considered for parole in 2025.
