October 14, 1996Daniel Angel Plata Estrada was born on August 2, 1975. He grew up in Harris County, Texas. In 1995, at the age of 19, he became involved in a serious crime that would change the course of his life. He was later convicted of murder.
On May 6, 1995, Daniel Angel Plata Estrada shot and killed Murlidhar Mahbubani, a convenience store clerk, in Harris County, Texas. The shooting was done with a .25 caliber pistol during a robbery. Plata Estrada was arrested and charged with capital murder later that year.
On October 14, 1996, he was found guilty of capital murder by a jury. His sentence was death, which was announced by the trial court on December 11, 1996. After his conviction, Plata Estrada's legal team filed several appeals, arguing various points, including his mental capacity.
In 2003, he filed a writ of habeas corpus claiming he was mentally retarded and should not face execution. This claim was based on a Supreme Court ruling in 2002 that stated the death penalty was not applicable for mentally retarded individuals. The court reviewed this new claim and held a hearing where experts testified about his mental capacity. The trial court concluded that he was mentally retarded.
As a result, his death sentence was commuted to life in prison on January 16, 2008. Daniel Angel Plata Estrada remains incarcerated.
